The terms and conditions subject to Airtel Payments Bank Services are provided herein.

 

Terms and Conditions

The use of Airtel Payments Bank Services by the customer is subject to the acceptance of the following Terms and Conditions.


By enrolling for Airtel Payments Bank Services, the customer acknowledges that the customer has read, understood and agrees to be bound by these Terms and Conditions.

 



Airtel Payments Bank General Terms and Conditions

As an Account holder of Airtel Payments Bank Ltd (hereinafter referred to as the “Bank”), the Customer is subject to the below Terms and Conditions (T&C). Any changes to the T&C will be available on the website www.airtel.in/bank  the use of Bank services by the Customer is subject to the acceptance of the Terms and Conditions.

By enrolling for the Bank services, the Customer acknowledges that the Customer has read, understood and agrees to be bound by these Terms and Conditions.


1. DEFINITIONS

1.1. “Account” refers to the Customer’s savings account or Wallet or any other type of account so designated by the Bank to be eligible account(s) for the operations.

1.2. "Airtel Payments Bank Limited" is a company incorporated under the Companies Act, 2013 with its registered office at Bharti Crescent, 1, Nelson Mandela Road, Vasant Kunj, Phase II, New Delhi - 110070, India.

1.3. “Banking Points” shall mean and include business correspondent agents.

1.4. "Charge(s)" or "Service Charge" shall mean the charges which the Bank may levy upon the Customer in consideration for the Bank services.

1.5. "Customer" shall mean an individual person who has registered with the Bank for availing its services and has accepted all applicable terms and conditions of the Bank and owns a compatible mobile phone that supports Bank services.

1.6. “Customer ID”/ “Mobile number” shall be the ten digit mobile phone number of the Customer to be used for Account login.

1.7. "Enrollment Form" shall mean the form to be completed by the Customer along with necessary supporting documents, as required by the Bank.

1.8. "KYC" stands for Know Your Customer and refers to the various norms, rules, laws and statutes issued by RBI from time to time under which Bank is required to procure personal identification details and proof of address documents from the Customer as may be required from time to time for availing and / or continuation of the Bank services.

1.9. "mPIN" shall mean the 4 digit secret numeric password used to secure Bank
Account, without knowledge of which the Bank Account may not be operable.

1.10. “Instruction”/ “Instruction(s)” means any request or instruction that is received from the Customer by the Bank through any Banking access channel.

1.11. “SMS Password (OTP)” refers to one time 6 digit pass code that would be sent to a Customer’s mobile number registered with the Bank.

1.12. "USSD" means Unstructured Supplementary Services Data and refers to a method of accessing and using the Bank Account, i.e. by dialing a specified short code from the mobile number registered with the Bank.

2. INTERPRETATION

2.1. All references to singular include plural and vice versa and the word "includes"
should be construed as "without limitation".

2.2. Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.

2.3. All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of
these Terms & Conditions.

3. DOCUMENTATION

3.1. The collection, verification, audit and maintenance of correct and updated
Customer information is a continuous process and Bank reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements. Bank reserves the right to discontinue services/ reject applications for Bank services at any time if there are discrepancies in information and/or documentation provided by the Customer at the time of Bank Account opening.

3.2. Any information, provided to the Bank with the intention of taking its services, shall vest with the Bank, and may be used by the Bank, for any purpose consistent with any applicable law or regulation, at its discretion.

3.3. If the particulars provided by the Customer in the KYC documents do not match with details mentioned in the Enrollment Form, then Bank has the right to call for additional documents to the satisfaction of the Bank as per the extant KYC guidelines.

 

4. GENERAL CONDITIONS OF BANK SERVICE

4.1. For an Airtel customer his/her mobile number shall be his/her Bank account number. For non Airtel customers his/her account number shall be a ten digit sequential number provided by the Bank. Notwithstanding anything, once Bank allots a mobile number as an account number to a Customer it is not subject to change in any case including a customer availing mobile number portability services or changing his mobile number and the same shall not be reassigned to any other Customer even if he/she possess the same mobile number.

4.2. The Customer may avail Bank services by approaching Banking Points and through Internet Banking as well. The list of Banking Points, any limits pertaining to the Account and methods of crediting Bank Account are subject to change as per discretion of Bank without any prior intimation to the Customer.

4.3 The maximum savings account balance at the end of the day shall not exceed INR 1,00,000/-(Rupees One Lakh). In case the limit is exceeded, the balance in addition to one lakh rupees will not accrue interest.

4.4 Bank reserves the right to close the savings account of such Customers who maintain balance of more than Rs.1,00,000 for a continuous period as determined by the Bank from time to time despite sms communication from the Bank to restrict the end of the day balance below or equal to Rs.1,00,000

4.5 The Bank would consider acceding to the fund transfers requests of the Customer within or external to the Bank, through instant payment methods or such other mode on best efforts basis.

4.6.The Bank shall reserve the right to close / temporarily block the Account of any Customer if:
-The Customer is violating the AML and PMLA guidelines
-The Customer does not furnish necessary re-KYC documents when required to do so based on the risk assessment made by the Bank
-The Customer fails to adhere to any of the terms & conditions of the Bank and / or any of the regulatory requirements.
-The Bank Account is being used for any unlawful or suspicious activity which is inconsistent with any of the Banking practice.
-Directions to the effect is received from the law enforcement authorities, regulatory authorities, etc.

4.7. Bank shall provide its services on best effort basis. Further Bank reserves the right to suspend/discontinue any of the Bank services at any time, for any cause, including, but not limited, to the following:
a) To combat potential fraud, sabotage, willful destruction, threat to national security or for any other force majeure reasons ;
b) For any suspected violation of the rules, regulations, orders, directions, notifications issued by RBI from time to time or for any violation of the Terms and Conditions mentioned herein.

4.8. The Customer is permitted to maintain and operate only one Bank Account.

4.9. Bank does not sponsor any particular product or any business unrelated to banking and any payment for purchase of goods and services by using the Bank’s services will be confined to payment arrangement with such entities or its subsidiaries/associates/principal.

 

5. BANK CHARGES

5.1. The Customer shall pay the Service Charges prescribed by the Bank that may be changed, amended, increased, modified or reduced at the Bank’s discretion, from time to time with prior intimation to the Customer in an upfront manner. 6. CUSTOMER OBLIGATIONS

6.1. The Customer shall be solely responsible for the confidentiality, safety and security of the mPIN. The Customer shall be the sole owner of the mPIN and shall be responsible for the consequences arising out of disclosure of the mPIN and/or the unauthorized use of its use and of Bank services. In case the mPIN is forgotten it can be regenerated through the Banking Points or through Bank app.

6.2 In case the mobile phone/ SIM card associated with the Bank services is lost/stolen/misplaced/ no longer in the Customer’s control or possession or is not operational, the Customer shall promptly inform Bank through its call centres or  email registered with the Bank.

6.3. The Customer shall intimate Bank about change in any information, including but not limited to change in address etc. within one week along with such proof of change as per the KYC documents prescribed by the Bank and further provide any information and document that Bank may request from time to time

6.4. The Customer shall not use the Bank services for any purpose that might be construed as contrary or repugnant to any applicable law, regulation, guideline, judicial dicta, Bank policy or public policy or for any purpose that might negatively prejudice the goodwill of the Bank.

8. INTEREST ON SAVINGS BANK DEPOSIT

Bank pays interest monthly at published interest rates on the daily end of day balance in the savings accounts.

 

9. RECOVERY IN CASE OF EXTRANEOUS CREDIT

9.1. If no funds are available in the Bank Account to pay fees/charges, Customer authorizes Bank to set off any available credit, including future amounts flowing into the Bank Account.

 

10. ACCOUNT FREEZE

10.1. The Bank has the right to freeze the Bank Account if it is suspected that operations in a Customer’s Bank Account are being carried out in disproportion to his/her profile and/or source of funds are not known to the Bank.

 

11. ACCOUNT CLOSURE

11.1. Customer authorizes the Bank to close his/her Bank Account in the following circumstances, with intimation on high occurrences of dishonored Payments from my Account. If the Bank is not able to verify my Identity/obtain the necessary documentation either because the Customer didn’t cooperate or if the data/information provided by the Customer is not reliable.

11.2. Further the Customer understands that the Bank would levy, from the savings account balance, a charge of Rs.50 at the time of closure and the Customer will be required to maintain the equivalent amount at all times in his/her Bank Account.”

11.3 Customer acknowledges and agrees that he/she cannot close the savings account within the first 30 days of opening savings account with the Bank.”

 

12. REVERSAL OF ENTRIES

12.1. The Bank reserves the right and the Customer hereby authorizes the Bank to reverse any entries erroneously/extraneously passed, with or without notice to/from the Customer and to debit/credit the Account to the extent required to correct any erroneously/extraneous entries that may have been inadvertently made by the Bank.

 

13. DORMANT ACCOUNTS

13.1. The Bank shall flag the Account as “Dormant” if the Account remains inoperative for continuous period of two (2) years and no transactions are carried therein. The Customer agrees that the Bank may place restrictions on the operation of the Account till such time the Customer reactivates the Account through a process specified by the Bank. For this purpose Customer induced transactions shall only be considered.

 

14. DEATH OF A CUSTOMER

14.1. In case of death of a Customer, the Bank shall follow the due process /procedure to pay the money lying in the Account of the deceased.

 

15. NOMINATION

15.1. Nomination facility is available for the Account. The Customer can nominate one individual for the purpose. The Customer is at liberty to change the nominee as per the Bank process.

 

16. CONFIDENTIALITY

16.1. Any information relating to the Customer is generally used to provide the Bank services, improve the Bank services and otherwise.

 

17. DECLARATION BY THE BANK

17.1. The Bank shall not be responsible for any acts or omissions of any third party including merchants and all Banking Points, with regard to services which are not expressly authorized by the Bank.

17.2. The Bank shall not be liable to any person for any delays, loss of business, profit, revenue or goodwill, anticipated gains (included opportunity loss), damages, fees costs, expense, etc. or for any indirect or consequential loss, howsoever arising, on the Bank Account being unavailable/usage of the Bank services or otherwise.

17.3. The Terms and Conditions herein shall be subject to the notifications/ guidelines issued by RBI, from time to time.

17.4. The Bank will on best effort basis ensure that Customer transactions and information remain secure and confidential.

 

18. INDEMNITY

18.1. The Customer agree to indemnify, defend and hold the Bank and/or related parties harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including and without limitation legal fees and expenses, arising out of or related to the use or misuse of the Bank services, any violation of these Terms and Conditions, or any breach of the representations, warranties, and covenants.

 

19. ADDITIONAL T&Cs

19.1. In the event of any dispute, the Bank’s records shall be taken as the conclusive evidence of the transactions carried out through use of its services.

19.2. The Bank shall send all Customer communications by SMS and the SMS shall be deemed to have been received by the Customer after they have been submitted for delivery to the mobile phone operator. The Bank, at its own discretion, may also contact the Customer, for all purposes necessary for providing & improving its services and suggesting any additional services.

19.3. The Bank will in no way be held responsible or liable for delay, failure and/or untimely delivery of SMS one time password (OTP) and/or SMS Alerts due to but not limited to network congestions, network failure, systems failure or any other reasons beyond the reasonable control of the Bank or its service provider(s).

19.4. The request for opening of savings bank account will also be taken as customer request for debit card issuance and Form 60 filled by the customer for savings bank account will also be applicable for debit card issuance.

 

20. SEVERABILITY

20.1.  If any part of this Terms and Conditions is adjudged void or inoperable for any reason, the same shall be severed from the remainder of the Terms and Conditions and only that portion of this Terms and Conditions that is specifically adjudged void or inoperable shall cease to govern the relationship between the Bank and the Customer.

 

21. JURISDICTION

21.1. The Courts at New Delhi shall have exclusive jurisdiction in respect of any dispute regarding the use of Bank service including the interpretation and execution of this Terms and Conditions or any other document executed by the Customer or the Bank with respect to Bank service.

 

22. GRIEVANCE REDRESSAL

22.1. In case the Customer has any complaint relating to the features of any of the Bank services that the Customer holds and/or avails of, Customer can approach the Grievance Redressal Cell within the Bank at grievance.officer@airtelbank.com for a resolution and if he/she does not get a satisfactory response within 30 days of lodging the complaint, then, under the Banking Ombudsman Scheme 2006, such Customer can approach the Ombudsman appointed by the Reserve Bank of India, in charge of the region where he/she has an Account, details of which are available at www.bankingombudsman.rbi.org.in.

 

23. DECLARATION BY CUSTOMER

I (“the Customer”) agree that the opening and maintenance of the Account is subject to rules and regulations introduced or amended from time to time by the Reserve Bank of India. I hereby certify that I / we have declared my/our status as per the rules applicable under section 285BA of the Income Tax Act, 1961 as notified by Central Board of Direct Taxes (CBDT) vide Notification No. S.O. 2155(E) dated 7 August 2015 and RBI Circular Ref No. DBR.AML.BC.No.36/14.01.001/2015-16 dated
28 August 2015 in this regard. I understand and acknowledge that as per the provisions of Income Tax Act, Rules made there under and the guidelines issued by the RBI in the matter, depending upon the residential status and/or other criteria stipulated therein, the Bank may have to report the details in respect of Bank Account(s) as per the prescribed format to the Central Board of Direct Taxes (CBDT) or other Government Agencies to comply with the obligations as per the Inter-Governmental Agreements (IGA) in respect of Foreign Accounts Tax Compliance Act (FATCA) and Common Reporting Standards (CRS) and or any other similar arrangements.

  • I certify that the information provided by me above as applicable to me by me/us as well as in the documentary evidence provided by me are, to the best of my knowledge and belief, true, correct and complete and that I have not withheld any material information that may affect the assessment/categorization of my Account as a U S Reportable Account or Other Reportable Account or otherwise. I undertake the responsibility to declare and disclose within 30 days from the date of change, any changes that may take place in the information provided by me, as well as in the documentary evidence provided by me or if any certification becomes incorrect and to provide fresh and valid self- certification along with documentary evidence.
  • I also agree that my failure to disclose any material fact known to me, now or in future, may invalidate me from transacting in the Account and the Bank would be within its right to put restrictions with respect to the operations of my Account or close it or report to any regulator and/or any authority designated by the Government of India (GOI) /RBI for the purpose or take any other action as may be deemed appropriate by the Bank, under the guidelines issued by CBDT/RBI from time to time, if the deficiency is not remedied by me within the stipulated period.
  • I also agree to furnish and intimate to the Bank any other particulars that are called upon me to provide on Account of any change in law either in India or abroad in the subject matter herein.
  • I agree to abide by the Bank's Terms and Conditions and rules in force and the changes thereto in T&Cs from time to time relating to my Account as communicated and made available on the Bank's website.
  • I authorize the Bank to use information which is KYC documents , particulars provided and usage based relationship information, for Account opening purpose/ any other purpose. I authorize the Bank to link my Bank Account with Aadhaar number for electronic transfer of subsidies. Related entities and further solemnly authorize Bank to use or share my documents and/or information provided for provision of third party products.
  • KYC: My Personal /KYC details may be shared with KYC Registry. I hereby give consent to receive information from Central KYC registry through SMS/e mail on the above registered number/e mail address.
  • I authorize the Bank to use my biometric authentication as my e-signatures for all Bank services.

Bharti AXA insurance Terms and Conditions

Airtel Payments Bank Ltd (“Bank”) is providing the free insurance cover to savings account customers by partnering with Bharti AXA General Insurance Company Ltd (“Insurance Partner”) (hereinafter referred as the “Policy”).

Please note that Bank shall not be responsible for this Policy offered by its Insurance Partner and any/all matters pertaining to the same shall be the sole responsibility of the Insurance Partner.

 

1. DEFINITIONS

Any word or expression to which a specific meaning has been assigned in any part of this Policy or the Schedule shall bear the same meaning wherever it appears. For purpose of this Policy, the terms specified below shall have the meaning set forth:

"Accident" means a sudden, unforeseen, and involuntary event caused by external, visible and violent means.

"Injury" means accidental physical bodily harm excluding illness or disease solely and directly caused by external, violent and visible and evident means which is verified and certified by a Medical practitioner.

Insured Person” means any Airtel Payments Bank savings account holder with an active insurance cover.

 

2. Benefits Covered

Accidental Death only: If at any time during the period of this Policy, the Insured Person shall sustain any bodily injury resulting solely and directly from accident caused by external, violent and visible means, then the Insurance Partner shall pay to the Insured person’s nominee or legal representative(s), as the case may be, the sum or sums hereinafter set forth, that is to say -

  • if such injury shall within twelve calendar months of its occurrence be the sole and direct cause of death of the Insured Person, the Capital Sum Insured stated in the Schedule hereto;

 

3. Conditions for issuance of Policy
  • Savings Bank account holder of Airtel Payment Bank Ltd. between ages 18 to 70 years. Subsequent renewal of Policy shall be subject to the savings account customer attaining the age of 75 years.
  • Customers opening new Airtel Payments Bank savings account and holding an active Airtel mobile connection would be covered under the terms of the Policy for a period of 30 days commencing from the date of activation of the Policy.
  • Policy shall be activated within 24 hours of Airtel Payments Bank savings account activation.
  • Policy shall be renewed after every 30 days on savings account holder carrying out at least one successful financial transaction (except credit transaction) at any banking channel including but not limited to Banking Points, USSD, Bank App etc, and continuing to use the Airtel mobile connection.
  • The claim shall be admissible only if the Policy is active.

 

 

4. Sum Insured

4.1. Rupees One Lakh only per savings account holder.

 

5.General exclusions to the Policy

PROVIDED ALWAYS THAT the Insurance Partner or the Bank shall not be liable under this Policy for-

  • Death resulting directly or indirectly or caused by, contributed to or aggravated or prolonged by child birth or from pregnancy or in consequence thereof.
  • Any pre-existing disability / accidental injury.
  • Accidental death due to mental disorders or disturbances of consciousness, strokes, fits or convulsions which affect the entire body and pathological disturbances caused by the mental reaction to the same.
  • Accidental death caused by curative measures, radiation, infection, poisoning except where these arise from an accident.
  • Any claim in respect of accidental death of the Insured Person
    • from intentional self-injury, suicide or attempted suicide
    • self exposure to needless perils except in an attempt to save human life
    • whilst under the influence of liquor or drugs or other intoxicants
    • whilst engaging in aviation or ballooning whilst mounting into, dismounting from or travelling in any aircraft or balloon other than as a passenger (fare paying or otherwise) in any duly licensed standard type of aircraft anywhere in the world
    • directly or indirectly, caused by venereal disease, AIDS or insanity
    • arising or resulting from the Insured Person committing any breach of law or participating in an actual or attempted felony, riot, crime, misdemeanour or civil commotion
    • whilst engaging in racing, hunting, mountaineering, ice hockey, winter sports.
  • Any consequential loss or damage cost or expense of whatsoever nature.
  • Death due to accidental injury arising out of or directly or indirectly connected with or traceable to war, invasion, act of foreign enemy, terrorism, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, mutiny, military or usurped power, seizure, capture, arrests, restraints and detainments of all Kings, Princes and people of whatsoever nation, condition or quality.
  • Death due to accidental injury, directly or indirectly, caused by or contributed to or by or arising from -
    • ionizing radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste or from the combustion of nuclear fuel and for the purposes hereof, combustion shall include any self-sustaining process of nuclear fission;
    • nuclear weapons material.
  • Insured Person whilst engaging in speed contest or racing of any kind (other than on foot), bungee jumping, parasailing, ballooning, parachuting, skydiving, paragliding, hang gliding, mountain or rock climbing necessitating the use of guides or ropes, potholing, abseiling, deep sea diving using hard helmet and breathing apparatus, polo, snow and ice sports.
  • Insured Person whilst flying or taking part in aerial activities (including cabin crew) except as a fare-paying passenger in a regular Scheduled airline or air charter company
  • Any accident to an Insured Person which arises in the course of his/her occupation if his/her occupation falls within the following categories or involves the following activities: - Air crew, ship crew, professional sportsman, diving, oil-rig platform and/or off-shore work, fire fighting, police, naval, military, air force service or operations and any hazardous occupation.
  • The insurance under this Policy shall not extend to cover any benefit under the Policy resulting directly or indirectly caused by, contributed to or aggravated or prolonged by misfeasance, malfeasance or nonfeasance or breach of trust in relation thereto by the Insured/ Insured Person.

 

6. Duty of the nominee or the legal representative of the Insured Person on occurrence of loss

On the occurrence of loss within the scope of cover under the Policy, the nominee or the legal representative of the Insured Person shall:

  • give written notice with full particulars to the Insurance Partner immediately. In case of death, written notice of the death must, unless reasonable cause is shown, be so given before internment / cremation, and in any case, within one calendar month after the death.
  • proof satisfactory to the Insurance Partner shall be furnished on all matters upon which a claim is based
  • in the event of death, to make a post-mortem examination of the body of the Insured Person or such other evidence as the Insurance Partner may from time to time require shall be furnished within fourteen days after a demand in writing.
  • allow the medical practitioner or any agent of the Insurance Partner to inspect the medical and hospitalisation records and to examine the deceased Insured Person.
  • assist and not hinder or prevent the Insurance Partner or any of its agents in pursuance of their duties.

In case the nominee or the legal representative of the Insured Person does not comply with the provisions of this clause or other obligations cast upon the nominee or the legal representative of the Insured Person under this Policy or in any of the Policy documents, all benefit under the Policy shall be forfeited, at the option of the Insurance Company.

 

7. Claim Documentation

The nominee or the legal representative of the Insured Person as the case may be, is required to submit the following documents while lodging a claim under the Policy:

  • Duly filled claim form
  • Death Certificate from the Municipal Authorities
  • Post mortem report
  • Police report / FIR
  • Any other document as may be required by the Insurance Partner

Free talktime offer (“Offer”)

  • 1. This Offer is available only to Customers opening new Airtel Payments Bank savings account (“Savings Account”) and holding an active Airtel prepaid mobile connection.
  • 2. All Savings Account opening terms and conditions shall apply to Savings Account opening. Please visit www.________.com for the terms and conditions.
  • 3. This Offer is applicable only on the cash deposited by a Customer at the time of opening a Savings Account.
  • 4. The talk time minutes credited shall be equivalent to the cash/amount(in count) with which the Savings Account has been opened not exceeding talk time of 500 minutes (For example, on Rs.1000 deposited for Savings Account opening, 500 prepaid talk time minutes will be credited to the Savings Account holder’s Airtel prepaid mobile connection).
  • 5. This Offer is available for usage within the territory of India for calls made from Airtel to Airtel prepaid mobile connection for a period of 30 days. At the expiry of 30 days from the commencement of this Offer any unused free talk time minutes shall stand forfeited.
  • 6. The provision of this Offer is a gratuitous offering and Airtel Payments Bank Ltd. or Airtel assumes no liability for any damages or losses arising out of the discontinuance or non-availability thereto.
  • 7. Airtel Payments Bank’s decision with regard to any Savings Account holder’s eligibility or continuance to avail this offer will be final.

Airtel Money Terms and Conditions of Usage

The terms and conditions subject to Airtel Money Services are provided herein.

The use of Airtel Money Services by the customer is subject to the acceptance of the following Terms and Conditions.

By enrolling for Airtel Money Services, the customer acknowledges that the customer has read, understood and agrees to be bound by these Terms and Conditions.

 

 

1. Definitions

1.1 “Airtel Payments Bank Limited, formerly Airtel M Commerce Services Limited or AMSL is a company incorporated under the Companies Act, 1956 with its registered office at Bharti Crescent, 1, Nelson Mandela Road, Vasant Kunj, Phase II, New Delhi - 110070, India and Principal Office at Airtel Center, Plot No. 16, Udyog Vihar, Phase-IV, Gurgaon-122015.

1.2 “Airtel Money Services” or “Services” refer to stored value card wallet services offered by Airtel Payments Bank under the certificate of authorisation issued by the Reserve Bank of India (RBI). Under the Services, Airtel Payments Bank issues the Airtel Money Account.

Airtel Money services are governed by:
(a) The Payment and Settlement Systems Act, 2007 & Regulations made there under
(b) Issuance and Operation of the Prepaid Payment Instruments in India (Reserve Bank of India) Directions, 2009 ("RBI Guidelines")
(c) Instructions issued by the RBI from time to time in respect of the same

1.3 "Customer" shall mean an individual person above the age of 18 years who has registered with Airtel Payments Bank Limited for availing the Airtel Money services and who has accepted these Terms and Conditions and owns a compatible mobile phone that supports the Airtel Money services.

1.4 “Access Channel” shall mean the method used by the Customer to access the Airtel Money services which includes USSD, IVR, SIM STK or the smartphone application available on the Google Play Store and the App Store.

1.5 “Airtel Money account” shall mean the Prepaid Payment Instrument issued by Airtel Payments Bank Limited including Express Account and Airtel Money account.

1.6 “Charge(s)” or “Service Charge” shall mean the charges which Airtel Payments Bank Limited may levy upon the customer in consideration for enrolling for the Airtel Money services.

1.7 “Card-to-Card Transfer” refers to a facility provided by Airtel Payments Bank Limited whereby an Airtel Money account can transfer funds from an Airtel Money account to any other Airtel Money account issued by Airtel Payments Bank.

1.8 “Card-to-Bank Transfer” refers to a facility provided by Airtel Payments Bank Limited whereby an Airtel Money account can transfer funds from an Airtel Money account to a savings or current bank account.

1.9 “Domestic Money Transfer” refers to Card-to-Card Transfer and Card-to-Bank Transfer.

1.10 “Merchant Establishment” shall mean and include physical merchants, remote merchants, electronic commerce merchants, mobile commerce merchants and/or any other merchants (including financial services) who have been authorised by Airtel Payments Bank Limited to accept payment for goods or services using the Airtel Money account.

1.11 “USSD” means Unstructured Supplementary Services Data and refers to a method of accessing and using the Airtel Money account, i.e. by dialing a specified short code from the registered Airtel Money mobile number.

1.12 “Enrollment Form” shall mean the form to be completed in writing by the Customer along with necessary supporting documents, as required by Airtel Payments Bank Limited for enrolling for the Airtel Money services.

1.13 “Express Account” shall mean an Airtel Money account classified as semi-closed system payment instrument issued by Airtel Payments Bank Limited by accepting minimum customer details, which can be used for purchase of goods or services at all identified Merchant Establishments including financial services and Domestic Money Transfers as per RBI guidelines.

1.14 “Power Account” shall mean an Airtel Money account classified as semi-closed system payment instrument issued by Airtel Payments Bank Limited by accepting full KYC document approved under Rule 2(d) of the PML Rules 2005, as amended from time to time, which can be used for purchase of goods or services at all identified Merchant Establishment including financial services and Domestic Money Transfers as per RBI guidelines.

1.15 “KYC” stands for Know Your Customer and refers to the various norms, rules, laws and statutes issued by the RBI from time to time under which Airtel Payments Bank Limited is required to procure personal identification details and proof of documents from the Customer as may be required at the time of enrolling for Airtel Money services and/ or on a later date, for availing and/or continuation of the Airtel Money services.

1.16  “m-Pin” shall mean the secret numeric password used to secure Airtel Money applications, without knowledge of which the Airtel Money account may not be operable.

1.17 “Transaction” shall mean any debit of money balance in the Customer’s Airtel Money account including but not limited to payment for purchase of goods or services at all identified Merchant Establishments including financial services or Domestic Money Transfers.

 

2. INTERPRETATION

2.1 All references to singular include plural and vice versa and the word “includes” should be construed as “without limitation”.

2.2 Words importing any gender include the other gender.  

2.3 Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force.

2.4 All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of these Terms and Conditions.

 

3. DOCUMENTATION

3.1 The collection, verification, audit and maintenance of correct and updated Customer information is a continuous process and Airtel Payments Bank Limited reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements. Airtel Payments Bank Limited reserves the right to discontinue services / reject applications for Airtel Money Services at any time if there are discrepancies in information and/or documentation provided by the Customer.

3.2. Any information provided to Airtel Payments Bank Limited with the intention of securing Airtel Money Services shall vest with Airtel Payments Bank Limited, and may be used by Airtel Payments Bank Limited, for any purpose consistent with any applicable law or regulation, at its discretion.

3.3. If the particulars provided by the Customer in the KYC documents do not match with details mentioned in the Enrollment Form, then Airtel Payments Bank Limited has the right to close the account and forfeit the balance therein.

 

4. GENERAL CONDITIONS OF AIRTEL MONEY SERVICE

4.1 The Customer will be issued an Express Account immediately after successful registration. The account can be upgraded to a Power Account after the Customer submits KYC documents at the time of registration itself or on a later date and the same are verified and approved by Airtel Payments Bank Limited. Power Account shall ordinarily be activated within twenty one (21) working days of receipt and verification of the associated documentation.

4.2 Processing fee for first cash load through agent is Rs. 15 (No processing fee on online cash load).

4.3 The Customer may credit the Airtel Money account through any of the methods mentioned at www.airtel.in/money. The list of cash-in outlets, limits and methods of crediting Airtel Money account are subject to change as per discretion of Airtel Payments Bank Limited without any prior intimation to the Customer.

4.4 The Customer may note that withdrawing cash and refunds from Airtel Money account is not allowed. Any outstanding credit in the Airtel Money account must be utilised only to make payments for bona-fide transactions.

4.5 Airtel Money services are available only to resident Indians who have attained the age of 18 years and are competent to contract.

4.6 Airtel Money services for Bharti Airtel Limited mobile connection holders is available on all the Access Channels subject to the Customer's mobile handset supporting these Access Channels. Airtel Money services for customers using other telecommunication services is available for other telecommunications service provider mobile connection holders is available only on the smartphone application available on the Google Play Store and the App Store.

4.7 Airtel Money services are not transferable.

4.8 The maximum monetary value that can be stored at any point of time in an Airtel Money Power Account is INR 1, 00,000 (Rupees One Lakh Only). The maximum permitted value of all transactions in a single day for Airtel Money Power Account is INR 50,000 (Rupees Fifty Thousand Only).

4.9 The maximum monetary value that can be stored and utilised in a month in an Express Account is INR 10,000 (Rupees Ten Thousand Only).

4.10 The maximum monetary value that can be transferred under Domestic Money Transfer for an Express Account in a single month is INR 10,000 (Rupees Ten Thousand Only) and is also subject to a per transaction limit of Rs. 5,000 (Rupees Five Thousand Only).

4.11 The maximum monetary value that can be transferred under Domestic Money Transfer for a Power Account in a single month is INR 25,000 (Rupees Twenty Five Thousand Only) and is also subject to a per transaction limit of Rs. 5,000 (Rupees Five Thousand Only).

4.12 For Transactions through USSD, the maximum permitted value of a single transaction is INR 5,000 (Rupees Five Thousand Only).

4.13 These limitations stated in clauses 4.7, 4.8, 4.9 4.10  & 4.11 may be reviewed and modified at the discretion of Airtel Payments Bank Limited without prior intimation to the Customer.

4.14 Airtel Payments Bank Limited reserves the right to suspend/discontinue Airtel Money services at any time, for any cause, including, but not limited, to the following:

(a) For any suspected discrepancy in the particular(s), documentation or Enrollment Form provided by the Customer
(b) To combat potential fraud, sabotage, willful destruction, threat to national security or for any other force majeure reasons etc.
(c) If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons
(d) If the same is due to any transmission deficiencies caused by topographical and geographical constraints/limitations
(e) If the mobile connection with which the Airtel Money Account is related ceases to be operational or in the Customer's possession or control
(f) For any suspected violation of the rules, regulations, orders, directions, notifications issued by RBI from time to time or for any violation of the Terms and Conditions mentioned herein
(g) If Airtel Payments Bank Limited believes, in its reasonable opinion, that cessation/ suspension is necessary

4.15 Airtel Payments Bank Limited may as per its discretion introduce appropriate controls including but not limited to revised Airtel Money Account limits. Airtel Payments Bank Limited may further request the Customer / beneficiaries of the Airtel Money services to submit additional KYC documents as part of ongoing monitoring and customer due diligence.

4.16 The value stored in the Airtel Money account shall NOT be refunded under ANY circumstances. The Customer must utilise the value stored in the Airtel Money Account to make payments for bona-fide transactions.

4.17 The Customer is permitted to maintain and operate only one Airtel Money Account. Any suspected non-conformity with this requirement shall be cause for the suspension/ discontinuation of any/all Airtel Money Accounts associated with the Customer by Airtel Payments Bank Limited.

 

5. BILLING AND PAYMENT

5.1 The Customer shall pay the service charges prescribed by Airtel Payments Bank Limited in the form and manner prescribed for such payments. Airtel Payments Bank may at its discretion, change, amend, increase, modify or reduce the Service Charges from time to time without prior intimation to the Customer. For the list of Service Charges please refer to your company website (www.airtel.in/money) or call the Airtel Money Customer Care center.

5.2 Any value in the Airtel Money Account that is utilised towards making payments for any transaction shall be automatically debited from the Airtel Money Account. Airtel Payments Bank's responsibility is limited to the debiting of the Airtel Money Account and subsequent payment to any merchant establishment including financial services or transfer to the bank. Airtel Payments Bank does not endorse, promote, champion or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using the Airtel Money Services.

5.3 Airtel Payments Bank Limited reserves the right to recover funds for Transactions processed from the balance in the Customer’s Airtel Money Account. 

 

6. CUSTOMER OBLIGATIONS

6.1 Airtel Money Services availability is subject to the maintenance of an active mobile phone connection with a telecommunications service provider and a mobile phone handset supporting Access Channels on which Airtel Money Services work. The Customer is solely responsible for all liability arising from the unavailability of the Airtel Money Services due to non-maintenance of an active mobile phone connection with the telecommunications service provider or a mobile handset not supporting the Access Channels.

6.2 The Customer must ensure the availability of sufficient funds before executing any transaction from the Airtel Money Account.

6.3 The Customer shall be solely responsible for the confidentiality, safety and security of the mPIN. The Customer shall be the sole owner of the mPIN and shall be responsible for the consequences arising out of disclosure of the mPIN and/or the unauthorised use of Airtel Money Service. In case the mPIN is lost or misplaced, the Customer shall promptly inform Airtel Payments Bank Limited by calling on the customer care numbers where after the mPIN will be barred and a new mPIN will be issued to the Customer after necessary validation. In case the mobile phone/ SIM card associated with the Airtel Money Services is lost/stolen/misplaced/ no longer in the Customer’s control or possession or operational, the Customer shall promptly inform Airtel Payments Bank Limited.

6.4 The Customer shall only use the Airtel Money Services for transactions with the approved merchant establishment including financial services and banks. The list of merchant establishments including financial services and banks is available at www.airtel.in/money and is subject to change at Airtel Payments Bank's Limited discretion without prior intimation.

6.5 The Customer shall intimate Airtel Payments Bank Limited about change in any information, including but not limited to change in address etc. within one week along with such proof of change as per the KYC documents and further provide any information and document that Airtel Payments Bank Limited may request from time to time.

6.6 The Customer shall not use Airtel Money Services for any purpose that might be construed as contrary or repugnant to any applicable law, regulation, guideline, judicial dicta, Airtel Payments Bank Limited policy or public policy or for any purpose that might negatively prejudice the goodwill of Airtel Payments Bank Limited.

6.7 The Customer shall acknowledge and understand that Airtel Money Services are linked to the mobile phone connection and the Customer shall be solely responsible for any liability arising out of the loss/ theft / misuse of the mobile phone number or deactivation of mobile connection by the telecommunications service provider.

6.8 Information submitted by the Customer for availing the Airtel Money Services or information submitted while using Airtel Money Services may be shared with third parties (including but not limited to Bharti Airtel Limited) by Airtel Payments Bank Limited, inter alia, to facilitate the provision of Airtel Money Services.

6.9 Information submitted by the Customer for availing the mobile connection of Bharti Airtel Limited or information submitted by the Customer while using the mobile connection of Bharti Airtel Limited, can be requested from Bharti Airtel Limited and used by Airtel Payments Bank Limited to facilitate the provision of Airtel Money Services.

6.10 The Customer shall ensure that the Airtel Money Services are not used for transactions in foreign currency.

 

7. CONFIDENTIALITY

7.1 Privacy of communication is subject to the terms of the certificate of authorization granted by the RBI and RBI notifications/directives etc. The Customer need to specifically agree that in order to facilitate the provision of Airtel Money Services, Airtel Payments Bank Limited may be required to disclose any information or particulars pertaining to the Customer to any authority, statutory or otherwise.

7.2 The user interfaces, graphics, logos, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of the Airtel Money Service provided by the Airtel Payments Bank Limited (the “Materials”) are protected by copyright, designs, patent, and trademark laws, international conventions and other applicable intellectual property and proprietary rights of either Airtel Payments Bank Limited and/or its related parties.

7.3 Any information relating to the Customer is generally used to provide the Airtel Money Services, improve the Airtel Money Services and otherwise. 8. DISCLAIMER OF LIABILITY

8.1 Airtel Payments Bank Limited makes no express or implied warranty, guarantee, representation or undertaking whatsoever regarding the Airtel Money Services, which are not expressly mentioned herein.

8.2 Airtel Payments Bank Limited shall not be responsible for any acts or omissions by any third party including distributors/retailers/merchants etc., with regard to services which are not expressly authorised by Airtel Payments Bank Limited.

8.3 Airtel Payments Bank Limited shall not be liable to any person for any delays, loss of business, profit, revenue or goodwill, anticipated savings, damages, fees costs, expense, etc. or for any indirect or consequential loss, howsoever  arising, on Airtel Money Account being unavailable/usage of the Airtel Money Services or otherwise.

8.4 Airtel Payments Bank Limited shall not be liable to any person for injuries or damages resulting from omissions, interruptions, delays, errors in transmission, failures or defects in equipment, or disconnection of the mobile services by Bharti Airtel Limited or any other cause including but not limited to the failure to transmit, or any other causes beyond the control of Airtel Payments Bank Limited or for any reason whatsoever.

8.5 The Terms and Conditions herein shall be subject to the notifications/ guidelines issued by RBI, from time to time.

8.6 Airtel Payments Bank Limited will do its best to ensure that customer transactions and information remain secure and confidential. Airtel Payments Bank Limited makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by the Customer or by any person resulting from or in connection with the use of the Airtel Money Services.

9. INDEMNITY

9.1 The Customer must agree to indemnify, defend and hold Airtel Payments Bank Limited and/or related parties harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including and without limitation, legal fees and expenses, arising out of or related to the use or misuse of the Airtel Money Services, any violation of these Terms and Conditions, or any breach of the representations, warranties, and covenants.

 

10. ADDITIONAL T&Cs

10.1 Any dispute with or complaint against any merchant establishment including financial services or banks must be directly resolved by the Customer with the merchant establishment or financial services company or bank. It is clarified that Airtel Payments Bank Limited shall not be responsible or liable for any deficiency in goods and/or services purchased using Airtel Money Services. This exclusion of liability shall apply even for goods and/or services made available by Airtel Payments Bank Limited under promotional schemes. The Customer is instructed to satisfy themselves regarding the quality, quantity and fitness of any good and/or service before purchasing the same.

10.2 Any amount transferred erroneously by the Customer to any merchant establishment including financial services or bank account shall not be refunded to the Customer by Airtel Payments Bank Limited in any circumstances.

10.3 In the event of any dispute, Airtel Payments Bank Limited records shall be binding as the conclusive evidence of the Transactions carried out through use of Airtel Money Services.

10.4 Airtel Payments Bank Limited shall send all customer communications by SMS and the SMS shall be deemed to have been received by the Customer after they have been submitted for delivery to the mobile phone operator. Airtel Payments Bank Limited, at its own discretion, may also contact the Customer, for all purposes necessary for providing & improving the Airtel Money Services and suggesting any additional services.

10.5 The Customer agrees to receive all commercial messages including transactional messages from Airtel Payments Bank Limited.

10.6 Additional Terms & Conditions for linking your Airtel Money Account with Uber:

By proceeding with linking their Airtel Money Account with Uber, the Customer agrees to be bound by the below mentioned additional Terms & Conditions. If you do not agree to these terms, please do not proceed with linking your Airtel Money Account with Uber.

1. The Customer hereby gives consent to Airtel Payments Bank Limited to link the Airtel Money Account with the Uber account and debit the Airtel Money Account according to the value of the Uber ride.
2. Once linked, the Customer can take Uber rides for a span of 3 years or 1000 rides (whichever expires before).
3. The Customer can delink the Airtel Money Account from the Uber account or increase the number of rides by sending a request to the Uber Customer Care: help.uber.com
4. For any queries relating to Uber account/services, the Customer can contact Uber Customer Care: help.uber.com

11. CHANGE OF TERMS

11.1 Airtel Payments Bank Limited has the sole discretion to change, add / or delete these Terms and Conditions.

11.2 Airtel Payments Bank Limited may modify, terminate and/or suspend Airtel Money Services to the Customer anytime with or without prior notice, due to any changes in internal policies, rules, regulations and laws set by relevant authorities/regulators.

11.3 Any amendment of these Terms and Conditions proposed by the Customer shall not be effective unless it shall be reduced to writing through an amendment form and accepted by Airtel Payments Bank Limited. Amendments made under this clause shall be deemed to be a part of these Terms and Conditions and in case of any contradiction the amendment form shall prevail.

11.4 Changed Terms and Conditions will be displayed on the Airtel Payments Bank Limited website or sent through SMS, USSD etc. This communication shall be valid and be considered as proper intimation. By continuing to use the Airtel Money Service, the Customer will be deemed to have accepted the changed Terms and Conditions.

 

12. SEVERABILITY

12.1 If any part of the Terms and Conditions is adjudged illegal or inoperable for any reason, the same shall be severed from the remainder of the Terms and Conditions and only that portion of the Terms and Conditions that is specifically adjudged illegal or inoperable shall cease to govern the relationship between Airtel Payments Bank Limited and the Customer.

 

13. JURISDICTION

13.1 The Courts at New Delhi shall have exclusive jurisdiction in respect of any dispute regarding the use of Airtel Money Service including the interpretation and execution of the Terms and Conditions or any other document executed by the Customer or Airtel Payments Bank Limited with respect to Airtel Money Service.
