• definitions

    • • "bharti airtel limited" or "airtel" means a company incorporated under the provisions of companies act, 1956, having its registered office at    bharti crescent, 1, nelson mandela road, vasant kunj, phase II, new delhi – 110 070.
      • “charges” shall mean all fees, rental/ handling charges, call charges and any other incidental costs chargeable by airtel from time to time for    availing the services.
      • “commencement date” means the date on which the SIM card is activated by airtel.
      • “customer” shall mean and include any person, his/her/its heirs, executors administrators, successors and assigns, who subscribes to the   airtel world sim™ (aws) services after completing the required formalities in accordance with the terms of contained herein. Mere execution of the sef shall neither constitute person to be a customer/ subscriber or consumer of airtel.
      • “Subscriber enrolment Form” or “sef” shall mean the non-transferable form appended herewith, which has been filled and executed by the   customer for subscribing to the services.
      • "airtel world services™" service shall mean international roaming facility by providing the SIM card to the customer for his/ her use when he/    she is not in India.
      • “Services” shall mean providing of airtel world sim™ services, by providing the SIM card to the customer by airtel on such terms and    conditions as notified by airtel alongwith the terms and conditions contained herein.
      • “subscriber Identification Module Card” or “SIM card” shall mean a non-transferable activation device, being a card or programmed microchip,    provided and owned by airtel to enable the customer having a mobile phone to gain access to the airtel world sim™ service; when he/she is travelling outside India.
      • “termination date” means the date on which the customer notifies airtel in writing or returns the SIM card to airtel or the SIM is deactivated    or the SIM validity expires, whichever is earlier.
  • reservations

    • airtel reserves the right:
      i) To seek and/ or verify the particulars including financial information provided by the customer, either by itself or from independent sources.
      ii) To reject any SEF, in case the particulars provided therein are incomplete, incorrect or for any other legally just and valid reason. The     information provided by the customer/ gathered by airtel shall become airtel’s property even if SEF is rejected and airtel may use the said     data for any lawful purpose, subject to the applicable laws and regulations
      iii) At its sole discretion to amend the terms and conditions at any point of time.
  • customer's obligations

    • • Customer shall fulfill the following Conditions to avail the service of airtel world sim™
      • airtel world sim™ customer willfully agrees to pay for the tariff of all calls forwarded from airtel SIM mentioned on the subscriber   enrolment form.
      • The SEF has to be correctly, completely filled and duly signed in the presence of the authorized representative of airtel. The details filled in   shall be in accordance with the documents submitted along with this SEF.
      • Documents required are self attested; photograph, passport, visa/ ticket, proof of address. In case documents are inaccurate or incomplete,   the services to the SIM shall be barred. No refunds shall be provided in case of barring due to inaccurate/incomplete documentation.
      • At the request of airtel the customer shall be under an obligation to provide the original copy of any of documents(s) or such document that   airtel may request for the purposes of verification of any matter relating to the customer at any point of time.
      • If the SIM is lost or stolen, the customer shall forthwith inform airtel, This notification shall authorize airtel to suspend all or any part of the   Services and/ or disconnect the services. However, the customer shall be liable for all the charges incurred before such notification and   suspension of services by airtel. Replacement of the lost or stolen SIM would incur additional charges. Any unused balance on the lost   airtel world sim™ will be transferred to the new airtel world sim™. However, airtel will only transfer that amount as per its system record from the time the customer has informed loss of SIM to airtel. No transfer/ liability will be entertained for any amount consumed before   reporting of lost SIM. Expiry of the new airtel world sim™ will be same as the lost SIM.
      • Customer shall comply with all the applicable laws, rules and regulations regarding the use of the services.
      • Customer shall not use or cause/ allow to use the services for any unlawful, immoral or abusive purposes in violation or derogation of any   law/rule or regulation or statutory directive or order for the time being in force or against any public policy or for sending/ receiving obscene,   threatening, harassing messages/ communications or sending messages or communications that affect national interest, or create any   damage or risk to airtel or its network/ equipments / call center and/or other customer(s). Any violation or misuse by customer shall under no   circumstances be attributed to airtel and the customer shall be solely responsible for all such acts or omissions.
      • Customer shall not use the services as a 'OSP' (other service provider) or for the purposes of telemarketing, directly or indirectly.
  • services

    • • Services will be provided within a reasonable time, on receipt of duly completed SEF for the benefit of the customer only and utilization of the    same in accordance with the terms and conditions contained herein and the applicable laws. airtel will use all reasonable endeavors to    provide and maintain service(s) during the relationship period.
      • Quality functionality, and/ or availability of the services, may be affected and airtel, without any liability, whatsoever, is entitled to refuse, limit    suspend, vary or disconnect the services, at any time, for any reasonable cause, including, but not limited, to the following:-
        i) any violation of applicable rules, regulations, orders. directions, notifications, conditions of license agreement etc, issued by government/      telecom regulatory authority of India (TRAI) etc.
        ii) any discrepancy in the particular(s) provided by the customer.
        iii) if the customer is in default (including past defaults) in making payment for the services or for any other telecom service provided by airtel.   iv) during technical failure, modification, up-gradation, variation, relocation, repair and/or maintenance of the systems/equipment.
        v) to combat potential fraud, sabotage, willful destruction, national security or for any other force majeure reasons etc.
        vi) transmission limitation caused by topographical, geographical, atmospheric, hydrological and/or mechanical or electronic constraints/      limitation and/or availability of suitable cellsites.
        vii) If services are used in violation of any law, rule/ regulation.
        viii) network failure of partner networks.
        ix) Any other reason, which is found to be reasonable by airtel warranting limiting/ suspension/ disconnection of services.
      • airtel will allocate a mobile number at it’s sole and absolute discreation. The said number shall remain in the exclusive domain and proprietary   of airtel and the customer is entitled to use the same only during the relationship period. Upon termination of the relationship period, airtel   shall have the right to allocate the said number to any other customer. It is made clear that the ownership and right over the allocated mobile   number shall vest the airtel in its sole discretion can alter/change the same for any reason whatsoever, including but not limited to any   directive of government/ quasi government authority. DoT, TRAI, technical reason etc.
  • billing, payment and security deposit

    • • The customer shall be liable for making payment as per the request made by airtel from time to time. All present/ future levies, charges,   taxes, duties etc. in relation to the services or the AWS service availed by the customer shall be the responsibility and liability of the   customer and is not limited to the territorial Jurisdiction of India.
      • It shall be incumbent on the customer to enquired about the calling charges from various countries.
      • The customer shall be liable to make the payment in accordance with the request of airtel without any objection or dispute.
      • All call charges will be charged in US dollars. On every recharge, the customer will get the talktime in US dollars at the exchange rate   applicable at the time packing of recharge voucher. Decision of airtel in this regard will be binding on the customer.
  • confidentiality

    • • Privacy of communication is subject to the terms of the license agreement of airtel with DoT and other statutory and regulatory notifications/   directives etc. The customer specifically agrees that in order to facilitate airtel to provide Services, airtel may be required to disclose any   information or particulars pertaining to the customer to any authority, statutory or otherwise, including but not limited to any debt collection   agency, credit reference agency, security agency, and reserves the right to comply with the directions of such authorities at its discretion and   without intimating the customer.
  • ownership

    • • The customer shall have no title and/ or ownership and /or interest in the SIM card and therefore shall not be entitled to transfer/assign/lease   or otherwise part with the same under any circumstances. The ownership and effective control over the SIM card shall always remain with   airtel, The customer shall return the SIM card immediately if asked for by airtel. The customer shall not claim any charge or lien on the SIM   card, even if any dispute is pending between the customer and airtel.
      • Further, acceptance of payments by airtel from a person other than the customer does not mean acceptance of transfer/ assignment/ lease   of any rights or obligation of the customer to such person making the payment.
  • termination and consequences

    • • Notwithstanding anything contained herewith, airtel shall be entitled to terminate/ suspend the services if -
        i) the customer fails to satisfy the verification process of the customer.
        ii) the customer fails to pay the charge/s due in accordance with the instruction of airtel; or
        iii) the customer is in breach of any other terms of the service.
      • Termination of this service under the preceding provision shall be without prejudice to and in addition to any right or remedy available to airtel   any applicable law or statute.
      • In the event of termination of the service for any reason whatsoever, airtel shall be entitled to recover any outstanding charges and dues from   the customer.
      • If the services is terminated for reasons for fraudulent / wrong information provided by the customer or if the product expires, the amount paid   by the customer shall be liable for forfeiture.
  • disclaimer of liability

    • • airtel makes no express or implied warranty, guarantee, representation or undertaking whatsoever regarding the services, which are not   expressly mentions herein.
      • airtel shall not be responsible for any acts or omissions of any third party including franchisees/ dealers/ distributors/ retailers etc. with regard   to services AWS service which are not expressly authorized by airtel.
      • airtel shall not be liable to the customer for any delays including any delay in activation of the SIM card, loss of business, profit, revenue or   goodwill, anticipated saving, use of contracts, damages, fees costs, expense, orders. judgment, etc. or for any indirect or consequential loss,   howsoever, it arises for or on account of unavailability/ usage of services or otherwise.
      • airtel shall not be liable to the customer for injuries or damages resulting from omissions, interruptions, delays, errors in transmission, failures   or defects in equipments, or any other cause including but not limited to the failure to transmit, which are connected with incidents of fire,   explosion, war riots, strikes, lockouts, picketing boycotts, and cause originating in the facilities or operations of other telecom or allied services   providers and other reasons or causes beyond the control of airtel of for any reason whatsoever.
      • The terms and conditions herein shall be subject to the notifications/ guidelines issued by TRAI and DoT, from time to time.
  • agreement

    • This terms & conditions is the complete and exclusive statement of the agreement between the parties and it supersedes all understanding or prior agreements, whether oral or written and all representations or other communications between the parties.
  • severability

    • If any part/clause of this SEF becomes illegal, invalid or unenforceable, that part/clause shall be ineffective to the extent of such invalidity or- enforceability only, without in any way affecting the validity or enforceability of the remaining parts of said provision/ clause or any other clause/ provision of this SEF.
  • governing laws and Juridiction

    • These terms and conditions alongwith the terms of using the services shall be governed by the laws of India. The courts at New Delhi shall have exclusive jurisdiction in respect of the subject matter of this SEF.
