Terms and Conditions

BY USING AIRTEL MERA HELLO TUNE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE ALONGWITH THE OTHER TERMS AND CONDITIONS THAT MAY APPLY. EACH TIME YOU USE AIRTEL MERA HELLO TUNE SERVICE YOU ARE RESPONSIBLE FOR BEING FAMILIAR WITH ANY CHANGES OR MODIFICATIONS TO THESE TERMS OF SERVICE, WHICH MAY OCCUR FROM TIME TO TIME. THESE TERMS OF SERVICE MAY BE UPDATED FROM TIME TO TIME.

When you submit your Content (hereinafter referred to as “Contribution”) to Airtel or to any of its channel or media, you agree by submitting, to grant Airtel a perpetual, irrevocable, royalty-free, non-exclusive, transferable, sub-licensable right and license to use, reproduce, modify, delete, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed to the full term of any rights that may exist in your contribution.

By submitting any contribution to the portal:-

i	You warrant that your contribution is your own original work and that you have the right to make it available to Airtel Mera Hello Tune Service for all purposes and to grant the right and license referred to above;

ii	You warrant that your contribution is not in any manner defamatory, libelous, slanderous, profane and does not infringe any law or person's rights; and

iii	You warrant that your contribution is not obscene, abusive, suggestive in whatsoever manner of any kind as mentioned herein;

iv	You have taken all possible care to ensure that your contribution will not attract any complaint; and

v	You indemnify Airtel against all damages, legal fees and others expenses that may be incurred by Airtel as a result of any breach of warranty or Terms of Service by you; and

vi	That the Contribution will not be held unlawful or illegal under the laws of India at any point of time.

You agree to use the Airtel Mera Hello Tune Service only for lawful purposes and in a way that does not infringe the rights of or restrict or inhibit anyone else's use and enjoyment of the Airtel Mera Hello Tune Serviceor is in breach of any terms of this Terms of Service. Contributions must be civil and tasteful.

Your Contribution shall be subject to the Airtel moderation policy or such other procedures that Airtel may at its sole discretion conduct before Your Contribution is made available as hello tune. Airtel does not warrant or represent that the Contribution will be made available as a hello tune either in the manner it is submitted nor subsequent to any moderations thereof. The availability of the Contribution as a hello tune is at the absolute discretion of Airtel and no communication or queries in this regards, shall be entertained by Airtel at any point of time.

In case Your Contribution falls in any of the following categories (which is descriptive and not exhaustive), the same shall not be made available as a hello tune at any time:-

i	anything abusive or threatening;

ii	material which is sexist, racist, homophobic, obscene or likely to harass or cause distress or be disruptive;

iii	swearing;

iv	spamming;

v	multiple posting;

vi	advertising; or

vii	impersonation;

vii	suggestive or similar to any of the above.

Should any Contribution at Airtel’s sole discretion is deemed or does fall within these categories, or to be undesirable in any way for the good running of the Airtel Mera Hello Tune Service or Airtel’s reputation, Airtel reserves the right to delete such contribution and/ or to block or restrict its availability or any further contributions by any means that You have used to make such contribution.

Airtel reserves the right to delete any contribution at its sole, unfettered discretion at any time without notice or explanation.

Airtel does not warrant that the Airtel Mera Hello Tune Service will be uninterrupted or error free or that the server which makes it available are free of viruses or bugs.

Disclaimer Of Warranties

10.1

YOU EXPRESSLY AGREE THAT USE OF THE AIRTEL MERA HELLO TUNE SERVICE IS AT YOUR SOLE RISK AND THAT THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BHARTI AIRTEL LIMITED, ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (HEREINAFTER "AIRTEL") DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

10.2

AIRTEL MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT PROVIDED ON OR VIA THE SERVICE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, OMISSIONS OR INACCURACIES OF CONTENT OR SUBMISSIONS, (II) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION THAT MAY BE CONTAINED THEREIN, (IV) ANY DELETION OF DATA OR INTERRUPTION OR DISCONTINUENCE OF TRANSMISSION TO OR FROM OR THROUGH THE SERVICE.

10.3

AIRTEL IS NOT RESPONSIBLE FOR ANY CONTENT OR TRANSACTIONS THAT IS CONTAINED OR MAY BE AVAILABLE OUTSIDE THE SERVICE. AIRTEL MAKES NO REPRESENTATIONS, WARRANTEES, GUARANTEES OR ANY ENDORSEMENTS AS TO THE QUALITY, SUITABILITY, FUNCTIONALITY OR LEGALITY OF ANY PRODUCTS, SERVICES OR OTHER OFFERINGS THAT MAY BE ADVERTISED OR MADE AVAILABLE BY A THIRD PARTY THROUGH THE SERVICE OR WHICH MAY BE LINKED TO THE SERVICE SUCH AS IN ADVERTISING OR A SUBMISSION. ACCORDINGLY, AIRTEL MERA HELLO TUNE SERVICE GROUP WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR ANY TRANSACTION THAT MAY OCCUR BETWEEN YOU AND SUCH THIRD PARTIES AND YOU SHOULD ALWAYS USE PRUDENT JUDGMENT AND READ THE PRIVACY POLICIES ON PORTALS OF SUCH THIRD PARTIES.

10.4

AIRTEL RESERVES THE RIGHT TO CHANGE ANY AND ALL CONTRIBUTION, SOFTWARE AND OTHER ITEMS USED OR CONTAINED AT AIRTEL MERA HELLO TUNE SERVICE AND ANY SERVICES AND APPLICATIONS OFFERED THROUGH THE AIRTEL MERA HELLO TUNE SERVICE SITE AT ANY TIME WITHOUT NOTICE.

LIMITATION OF LIABILITY

11.1

IN NO EVENT SHALL AIRTEL BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICE IN ANY MANNER, EVEN IF AIRTEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION AND, REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO AIRTEL MERA HELLO TUNE SERVICE GROUP FOR THE SERVICE DURING THE TERM OF MEMBERSHIP. YOU SPECIFICALLY AGREE AND UNDERSTAND THAT AIRTEL IS NOT LIABLE TO YOU FOR ANY SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT YOU ALONE ACCEPT SUCH RISK OF HARM.

INDEMNIFICATION

12.1

You agree to defend, indemnify and hold harmless Airtel from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Contribution caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.

MODERATION OF CONTENT

13.1

Though Airtel do have a process for moderation of content posted on the Content, but does not guarantee it to be a permanent feature, nor does they guarantee 100% accuracy and moderation of entire Contribution. By using the service you confirm that you have read, understood and accept the terms of use and are solely liable for whatever you upload, hear or download from the service.

MODERATION GUIDELINES

14.1

Contributions that fall under any of the following category shall not be made live on the Content and will be deleted from the system instantly.

i	Adverse, offensive / derogatory reference to any personality;

ii	Adverse, offensive / derogatory reference to communities, living or extinct;

iii	Adverse, offensive / derogatory reference to any city, building, geographical feature, etc. that can be singularly / uniquely identified in the world;

iv	Adverse, offensive / derogatory reference to physical / racial attributes;

v	Content which is lascivious or appeals to the prurient interest or the effect whereof is such as to tend to deprave or corrupt any person;

vi	Content which infringes any intellectual property right or confidentiality obligation;

vii	Reference which causes injury to religious sentiments;

viii	Adverse, offensive / derogatory reference to any companies, organizations, religious associations, political parties, governments (state and central), anyone’s private life, any other commercial and non-commercial entities; or

ix	Any content which is assumed to copied (fully or partially) from the original copyright content by means of manually recording, electronic gadgets etc.

CATEGORIES/PARAMETERS/REASON FOR DELETION

15.1

Below are the categories that will be used for explaining the customer for deleting his creation. The deletion of the song will be informed to the user through SMS with the reason of rejection mentioned.

i	Abusive

ii	Obscenity

iii	Copy right content

iv	Recording not clear

v	Offensive

Airtel Mera Hello Tune Services and the Contributions shall be governed as per the applicable laws of India and the courts of New Delhi only shall have exclusive jurisdiction over all or any matters arising out of or relating to the Airtel Mera Hello Tune Service or the Contribution.
