Terms & Conditions of Smartwatch

‘’Airtel Payments Bank Smartwatch" is a collaboration between Noise (Nexxbase Technologies) and Airtel Payments Bank Ltd. There are three main components to it: Rewards, Fitness, and Payments. Customers of Bank would receive a smartwatch with Bank-powered contactless payment capabilities as part of this scheme. The Smartwatch would have the NFC Chip which would enable the customer to make contactless payment at the merchant location. The smartwatch which includes a pedometer and its accessories would be entirely a product of Noise and the NFC Chip inserted in the smartwatch is a product of Bank Limited.

The following are the product's main components:

  • NFC/contactless chip enabling contactless payments at all NFC terminals·
  • Pedometer/Activity Tracker ( inbuilt as part of smartwatch) which records the number of steps you have walked
  • Bluetooth calling as part of smartwatch feature
  • Heart Rate Monitor as part of smartwatch feature

All the terms & conditions and warranty pertaining to the smartwatch would be covered by the Noise (The customer can access Noise Terms and Conditions at <<Noise Website>>  and terms and conditions pertaining to the Contactless chip would be covered by Bank.

Defintions

  • “The Bank”, “Bank”, means Bank Limited carrying on the business of banking and related services.
  • “Airtel Payments Bank Smartwatch , “Smartwatch, Contactless / NFC Chip,  refers to the Bank Wearable contactless Chip powered by MasterCard issued by Bank to its customers.
  • Contactless Payment: It is a faster way to pay with your account for purchases at participating stores. Instead of dipping (or swiping) your Card at the billing counter, simply wave or tap your watch on the contactless terminal and pay without entering a PIN (for amount under Rs.5000/-). For transaction above 5000, customer will have to enter the Card PIN on the merchant terminal.
  • “Bank Smartwatch holder”, “Contactless Chip Holder”, “NFC Holder” , “you”, “your”, “him” or similar pronouns shall where the context so admit, refer to a customer of Bank to whom an Bank contactless chip has been issued by Bank to operate on a nominated account(s).
  • “Account(s)”, refers to the Bank smartwatch holder's Savings or current Accounts that have been designated by Bank to the eligible account(s) for the valid operations. The Smartwatch holder should be the account holder of the bank.
  • “Transaction”, refers to the instruction given by Bank Smartwatch Holder by using his Bank Smartwatch contactless chip directly or indirectly to Bank to effect action on the account. (Examples of transactions can be retail purchases).
  • “International Transactions”, refers to the transactions performed by the Bank Smartwatch Holder through their  internationally valid contactless chip enabled with contactless payment outside India, Nepal and Bhutan.
  • “Statement”, means a periodic statement of account requested by Bank Smartwatch Holder from bank covering the transactions carried out by the holder during the given period and the balance on that savings/current account. It may also include any other information that Bank may deem fit to include.
  • “Merchant” or “Merchant Establishments”, shall mean establishments wherever located which accept/honour the payment using contactless chip and shall include amongst others: stores, shops, restaurants, airline organizations etc. advertised by Bank or Mastercard/Visa/RuPay International.
  • “POS”, refers to electronic Point-of-Sale swipe terminal, whether of Bank or any other bank on the shared network, that permit the debiting of the account(s) for purchase transactions from merchant establishments.
  • “Mastercard/Visa/RuPay”, means a trademark owned by an normally associated with Mastercard/Visa/RuPay International.

Bank Smartwatch Validity and Holder Obligations

The issue and use of the Contactless Chip shall be subject to the rules and regulations in force from time to time as issued by the Reserve Bank of India, Bank and other regulators whichever applicable.

The Contactless Chip shall be valid only for transaction options, as permitted by the Bank from time to time in India and only at Point-of-Sale swipe terminals at merchant establishments.

The Contactless Chip is not transferrable or assignable under any circumstance. You must not permit any other person to use it and should safeguard the Contactless Chip from misuse by retaining the Contactless Chip under your personal control at all times.

The activation code that the Bank Smartwatch Holder receives to activate the Contactless Chip, or any other number that the Bank designates, should only be known to the Smartwatch Holder. It is intended for the Holder's personal use alone, is completely confidential, and cannot be transferred. It is not advisable to retain a written record of the activation code number anywhere or in any way that could make it easier for a third party to utilize. Under no circumstances or by any means, whether voluntary or not, the code shall be divulged to any third party, including Bank employees. The Bank will use caution while providing the code and will be required to keep the code secret from the wearer of the smartwatch.

Any transactions made using the Contactless Chip will be promptly debited or credited (in case of refunds) to the Smartwatch Holder's Bank account. The account should have enough money in it for the Bank Smartwatch Holder to perform any such transactions.

Issuance of wearable to the customer would also be treated as an explicit consent from the customer to show him/her the  associated virtual debit card corresponding to it.. This virtual card can be used for the online (e-commerce) transactions also. The customer will have to enable the online transactions on its own.

The Bank Smartwatch Holder can make purchases at any merchant point of sale (POS) for less than Rs. 5,000 in a single transaction (without a PIN) and can make up to 10 transactions in a single day.

Smartwatch holder will be responsible for any transactions made with the Chip, and they will not hold Bank liable for any loss or damage resulting from any unauthorized use of the Chip, including any criminal action resulting from any violation of RBI guidelines or rules framed under the Foreign Exchange Management Act, 1999 or any other law being in force in India and/or any other country, state, continent, or territory anywhere in the world at the time. This will continue even after this agreement expires.

Card embossed on the smartwatch contactless chip has a maximum seven-year validity period. By cutting the Contactless Chip into multiple pieces when its expiration date approaches, you hereby agree to destroy it. After this time, you will need to purchase the Bank Smartwatch Program in order to receive the new smartwatch. The virual cards embossed on the smartwatch contactless chip will not be auto-renewed and no money shall be refunded to customer post expiry.

If the Bank Smartwatch Holder notices any anomalies or abnormalities in the transaction details on the statement of account that the Bank sends basis customer request, they must notify the Bank in writing within 15 days of receiving the statement . In the absence of any information within this time, the bank will presume that there are no anomalies and abnormities in the account statement.

You agree to an ongoing confirmation for use of your name, address, e-mail and mobile number for marketing / merchandising offers between Bank and Noise.

You do understand that a Service Tax is applicable on all fees, interest and other charges as per the Government of India regulations, and agree to pay the same.

One Smartwatch Program would be made available to one customer account

In case of loss/theft of activated Contactless Chip/Airtel Payments Bank Smartwatch, it would be your responsibility to report loss of Airtel Payments Bank Smartwatch to the Bank & specifically disable the Contactless transactions from Thanks app.

The onus of initiating complaint to appropriate authorities would be on the customer and Bank would not accept any liability to make up the loss suffered by you on account of using the Contactless Chip.

Smartwatch can only be used for the domestic usage only and international transaction are not allowed.

Merchant Establishment Usage

  • The Contactless Chip is accepted at all NFC electronic Point-of-Sale terminals at merchant establishments in India and Overseas which display the Mastercard/Visa/Rupay logo.
  • The Contactless Chip is Electronic Use only and will be accepted only at merchant establishments that have an NFC/ Contactless electronic Point-of-Sale swipe terminal. Any usage of the Contactless Chip other than electronic use will be deemed unauthorized and the Contactless Chip holder will be solely responsible for such transactions.
  • Always tap your Smartwatch Contactless Chip on the NFC Terminal yourself at the merchant establishment. Never share your Contactless Chip with anyone, including the merchant. While using your Contactless Chip on PoS machine, if you suspect something unusual, do not use the machine and report it to Bank immediately.
  • Bank prohibits withdrawal of cash using Contactless Chip at the POS, unless specifically permitted by us for specific accounts and amounts.

Important Consideration

  • It is recommended that time the Contactless Chip is used at a merchant business, you must sign the charge slip and save a duplicate of it. The bank will not provide charge slip copies. Any charge slip that you have not personally signed but that you can demonstrate was authorized by you will be considered your responsibility.
  • All Mastercard, Visa, and RuPay merchant locations with NFC-enabled electronic point-of-sale terminals accept the Contactless Chip. Regarding any transaction the merchant may have with you, including but not restricted to the provision of goods and services thus obtained or offered, Bank shall have no liability. Any complaints you may have about any Mastercard, Visa, or Rupay merchant establishment should be addressed with the merchant and bank shall not have any obligations towards merchant establishment.
  • In the event that customer is unable to use contactless payment at a merchant location due to system outages, delays, equipment failures, errors, or data loss of any kind, lost or unavailable connections, failed, incomplete, garbled, or deleted transmissions, or any other technological or technical difficulties or impediments, the bank shall not be held liable.
  • Customer has to ensure that the merchant cancels the transaction right away and gives you the slip if you decide to return the items and cancel your purchase after the Contactless Chip has been swiped. Any cancellations made after that will be processed by the acquiring bank as "chargebacks" on the merchant, which will take some time to finish. The amount's return, in full or in part, cannot be guaranteed.
  • The Bank disclaims all liability for any fees assessed by any merchant establishment that exceed the transaction amount and are deducted from your account.
  • A purchase and the credit that follows for returning goods or services are two different transactions. Only until the merchant receives the refund will it be refunded to your account (minus any cancellation fees that may apply at the merchant location). Customer must notify Bank and provide a copy of the merchant's credit note if the credit is not credited to your Contactless Chip account within 30 days of the refund date.
  • In case, there are insufficient funds in the said account, Bank will not honour the transactions.
  • The Contactless Chip holder would be solely liable for all unauthorized acts and transactions.

Fees

  • Transaction fees wherever applicable, will be debited from the account at the time of posting wherever applicable.
  • The Fess (Inclusive of GST) charged for Issuance of Wearable Form Factor which is a chip inserted in a Smartwatch would be non-refundable.

Features of the Smartwatch Contactless Chip

At its discretion, the Bank may occasionally partner with different organizations to provide a range of functions on your "Smartwatch Contactless Chip." The effectiveness, efficiency, and utility of any goods or services provided by any service providers, retailers, outlets, or agencies are not guaranteed or warranted by the Bank. Any disputes relate to smartwatch (if any) would need to be resolved directly with the merchant, agency, etc., and not through the Bank.

Disclosure of Information

The bank maintains the right to reveal customer information to law enforcement, quasi-judicial bodies, courts of competent jurisdiction, and any other branch of the federal or state governments.

Lost of Stolen Wearable

  • In the event that the Card is lost or stolen, the occurrence must be reported to Bank on contact number 1800-23400. You shall be required to disclose information regarding your Account Number, address, Date of Birth etc.. Under no circumstance should you disclose the PIN number or card number.
  • The loss or theft of the Contactless Chip should be reported to Bank immediately. Although loss or theft may be reported by means of the 24-Hour emergency Helpline Number, you must confirm the same on mobile app of the bank – wearable section as soon as possible. A copy of that acknowledged police complaint must accompany the said written confirmation.
  • Should transactions be received by Bank after the wearable  has been lost or stolen but before receipt of your written confirmation, customer shall be liable for all amounts debited to your account(s).
  • You hereby indemnify Bank fully against any liability (civil or criminal), loss, cost, expenses, or damages that may arise due to loss or misuse of the Contactless Chip in the event that it is lost and not reported to Bank , or lost and misused before Bank is informed.

General Considerations

  • Bank has the right to modify / alter all or any of the terms applicable to the program or discontinue this program at its sole discretion any time as Bank deems fit without assigning any reason or without any prior intimation whatsoever.
  • This program is subject to applicable law and regulations and would be modified / discontinued based on the prevailing law / regulation at any point of time and neither party shall be under any liability or obligation or continue implementation of the said program till such time the terms are modified by the Parties as per the prevailing/ amended law at that point of time.
  • In the event, that the program cannot be continued without total compliance of the prevailing law at any point of time, this program shall be deemed to be terminated forthwith from the date when the amended law restricting / prohibiting the program comes into force.
  • Any dispute relating to the program or the terms and conditions shall be subject to the jurisdiction of the courts in Haryana only.
  • Bank is not and shall not be held responsible for any deficiency in the Noise Smartwatch and any such issues related to the deficiency in the Noise smartwatch shall be settled by the customer without any reference to Bank.
