SECURE INTERNET: TERMS OF SERVICE

Please read these- ‘Secure Internet’ Terms of Service (“Agreement”) carefully before completing the registration process and/or using the ‘Secure Internet’ service. Organizations collaborating with Airtel in delivering its services will be referred to as “Service Partners”. This Agreement creates an agreement between you (‘User’ / ‘You’ / ‘Your’) and Bharti Airtel Limited / Bharti Hexacom Limited, as the case may be (‘Airtel’) (together with its affiliates, Service Partners, “we” or “us”) regarding User’s use of the ‘Secure Internet’ service, including any apps (“Apps”) that facilitate use of the ‘Secure Internet’ service ("Service", which includes the Subscription Services defined below).

 

You must be at least 18 (Eighteen) years of age to enter into this Agreement or access the Service. If you are entering into this Agreement on behalf of an entity, you must be properly authorized to represent that entity and to accept this Agreement on its behalf.

 

1. The ‘Secure Internet’ (‘Service’) is being offered by Airtel to Airtel Xstream Fiber subscribers, in India.

 

2. Secure Internet is a service which enables blocking of the traffic of malwares, computer viruses and categories of websites and apps as per the profile selected by the User. The blocking gets applied at broadband link level for all the devices connected on the link. User can choose among various profiles from Airtel Thanks App to manage the blocked categories.

 

3. Subject to the applicable terms and conditions, the ‘Service’ may be availed by all customer segments with Airtel Xstream Fiber plans across all telecom circles, in India except those who are availing Static IP service.

 

4. Subscription service and applicable terms/conditions-

 

4.1 Subscribing to the Service: To subscribe to the Service, You are required to be a registered user of Airtel Thanks App throughyour mobile number registered with your Airtel Xstream Fiber. To subscribe the Service, please visit Airtel Thanks App and click on ‘Thanks Section’ followed by ‘Secure Internet service’ banner. Follow the instructions for subscription. Post successful completion of the process, Airtel will notify you via SMS upon activation of the Services.

 

4.2 Subscription Charges: Subject to offer availability, Airtel may offer you complimentary service for the first month. You shall be liable for payment of subscription charges from the date of activation or upon completion of complementary service period, as may be applicable, including Applicable Taxes (defined below) of the Services in accordance with the selected subscription plan. Unless a request for disconnection is placed by you as per the prescribed process, the subscription period shall be renewed automatically for subsequent equivalent subscription period / terms unless you choose to opt out of subscription through Airtel Thanks App. The Subscription Services shall be added to Your Airtel Xstream Fiber bill. Airtel reserves the right to change fees for this Subscription Service at any point in time, upon advance notice being provided to you, through any mode of communication that’s available with Airtel. The new or additional subscription fees (as and when applicable) will apply prospectively. You are responsible for paying all applicable taxes or duties, including GST (“Applicable Taxes”), unless otherwise specified. Subject to any applicable laws, all amounts and charges including any taxes, duties, late payment fee that are due and payable shall remain payable or non-refundable, if already paid. Airtel is not obligated to refund any unused or inadvertently renewed subscriptions.

 

4.3 General Terms: Subscription Services may be enhanced, modified or revised any time at Airtel’s sole discretion and you would be notified in respect of the same. Your continued use of the Subscription Services after they have been changed shall constitute your acceptance of the changed Subscription Services and associated charges, if any. Depending on the type of Subscription Service, additional Subscription Services may be added to your Subscription either at no additional cost or at an incremental cost.. Airtel reserves the right to discontinue the Subscription Services at any time, in which case you will be notified in advance of such discontinuance and your Subscription will end as of the date of discontinuance.

 

4.4 Updates: Due to the nature of the subscription Services, the Services and underlying software will need to be updated from time to time during the Subscription Period (‘Updates’). ‘Updates’ include new patterns, definitions or rules for the Subscription Services security and parental control components (provided by Service Partner) and minor enhancements to the Software and accompanying documentation. Updates to Service Partner’s software and Service components are applied automatically by Service partner and cannot be opted out of without canceling your Subscription Services. Service updates related to the user interface of Secure Internet Service are provided by Airtel and shall be applied with or without an App Upgrade. Airtel will make the Service available and will provide basic technical support in its’ sole discretion. Airtel reserves the right to withdraw the Services (or any portion or feature thereof) at any time. In In addition, we may perform scheduled maintenance to update the servers and software that are used to provide the Service and, if necessary, perform emergency maintenance of the Service without notice.

 

4.5 Migration: If we cease offering the Services, your subscription for Services shall continue until the end of your ongoing subscription period. In such event, we may elect to migrate you to a similar Subscription Service and charge you any associated fee at the end of your ongoing Subscription Period. Any changes to your subscription Services or fees thereof, will be effective upon your next billing cycle, and will not apply retrospectively or to the remainder of your current Subscription Period. In the event we do migrate You you to a different Subscription Service, or modify your current Subscription Period or Subscription Fee, you may opt-out of these changes by cancelling your Subscription Service.

 

5. Communications:

 

From time to time we may send you communications to the email address or registered mobile number associated with your account, via in-product notice, post or on the Airtel website/app. These communications may include, but are not limited to, information about Updates and new features to the Service and other account-related or transactional messages. Communications will not include marketing or ad-related emails unless you expressly provide consent to receive them. Additionally, our mobile and tablet applications may, in some circumstances, offer the ability for you to receive push notifications in connection with those applications. If you would like to modify your ability to receive push notifications from our applications, you can control those settings within the settings or preferences apps of each respective device.

 

6. Confidentiality:

 

6.1 Neither you nor Airtel will disclose any ‘confidential information’ (as defined below), except to affiliates, employees, agents, Service partners or professional advisers who need to know such Confidential Information. The receiving party will ensure that anyone granted access to Confidential Information will use it only to exercise rights and fulfill obligations under this Agreement, while using reasonable care to keep it confidential. Notwithstanding anything to the contrary herein, the receiving party may disclose Confidential Information to the extent required by applicable legal process; provided that the receiving party uses commercially reasonable efforts to: (i) promptly notify the disclosing party of such disclosure before disclosing; and (ii) comply with the disclosing party’s reasonable requests regarding its efforts to oppose the disclosure. “Confidential Information” shall mean any non-public information, in whatever form, belonging to or disclosed by a party, that is identified as “Confidential” and/or “Proprietary” or that by its nature reasonably should be understood to be confidential and/or proprietary; provided, that it does not include information that is independently developed by the receiving party, is rightfully given to the receiving party by a third party without confidentiality obligations, or becomes public through no fault of the receiving party.

 

6.2 For implementing this Service, Airtel will monitor your browsing traffic to implement Secure Internet feature. Airtel is working with a third Party Service Partner. Airtel will provide access to your browsing traffic and DSL ID to third party partner to implement the Service. For the Service to work, Airtel will share your real time browsing data with the partner and based on algorithms of the partner, they block or allow the websites and apps. By agreeing to these terms, you allow Airtel to use the confidential data for the implementation of this Service.

 

7. Your Responsibilities as a Secure Internet User:

 

7.1 You are responsible for any data that is sent or received by you and/or any other party in connection with your use of the Service. You agree that Airtel is not responsible and will not be liable to you or any others for any loss or damage due to your use of the Service. You agree that your use of the Service will at all times comply with the applicable laws of the country where you use the Service. You may use the Service for your internal purposes only.

 

7.2 You shall not attempt (and you will not assist or permit any third party) to:

 

7.2.1 gain unauthorized access to the Service or any part or feature thereof, or to other accounts, computer systems or networks connected to the Service, whether through hacking, password mining or other means

 

7.2.2 copy, modify, create a derivative work of, reverse engineer, decompile, translate, disassemble, or otherwise attempt to extract any or all of the source code of the Service

 

7.2.3 You agree not to use any device, software or routine / hacking methods to interfere or attempt to interfere with, attack or disrupt the proper working of the Service or with any other person’s use of the Service.

 

7.3 Your sharing of information, either knowingly or unknowingly / negligently, related to the Service with others or allow others to access the Service, shallbe at your sole risk and cost. You agree to notify Airtel immediately of any unauthorized use of the Service or any other breach of security. Airtel shall not be liable for any loss that you may incur as a result of your breach of the terms and conditions of this Agreement and / or applicable laws. .

 

8. Subscription Service Usage:

 

8.1 The Service is intended to be accessed and used only for non-time-critical functions, information and/or access to and control of products. Our aim is to provide highly reliable and available Service to your network; however, the Service, including remote access and notifications, is not guaranteed to be reliable or available 100% of the time. In addition, the Service may be subject to sporadic interruptions and failures for reasons beyond Airtel’ control, including WiFi intermittency and maintenance. We cannot and do not guarantee that you will have access to the Service during any given time.

 

8.2 Disclaimer of Warranty. NOTWITHSTANDING ANYTHING CONTAINED ANYWHERE IN THIS TERMS OF SERVICE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES, CONDITIONS, REPRESENTATIONS OR GUARANTIES OF ANY KIND, EITHER EXPRESSED, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, TITLE, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. AIRTEL DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE. NETWORK AVAILABILITY MAY BE AFFECTED DUE TO VARIOUS REASONS INCLUDING FORCE MAJEURE, ACTS OF GOD, INCLEMENT WEATHER, TOPOGRAPHICAL/ GEOGRAPHIC/ DEMOGRAPHIC FACTORS, MAINTENANCE WORK, AVAILABILITY OF INTERCONNECTION WITH OTHER NETWORKS, ETC.

 

8.3 You acknowledge that the Service and any connected Product are not certified for emergency response or intended or suitable for use in situations or environments where failure, delay or errors or inaccuracies in the data or information provided could lead to death, personal injury or severe physical or environmental and economic damage.

 

8.4 The Service may not be accessible without: (a) a working WiFi network provided by Airtel Xstream Fiber; (b) an active Subscription active on the account registered with the Airtel Xstream Fiber.

 

8.5 The Service does not prevent or offer protection from malware or viruses if the User connects to any network other than Airtel or system other than the one contracted in this Agreement, and User’s systems (such as desktops, laptop, mobile phone, tablet etc.) gets infected with malware or virus.

 

8.6 Whereas Airtel and its Service Partner under this Service offer protection from threats such as malwares and viruses, it does not offer protection from advanced threats (including malwares and viruses), zero day threats (including malware and viruses) and DDoS attacks. The service doesn’t claim complete block all malware, viruses as it is technically not possible.

 

8.7 Whereas, Airtel and its Service Partner under this Service offer blocking of URLs based on user’s category selection for blacklisting, certain websites may still be accessible to the user if the owner of the website has categorized it under a different category, changed its domain category or categorized it under multiple categories not all of which have been blacklisted by the user.

 

9. Suspension or Termination of Your Account:

 

9.1 Airtel has the right, in its sole discretion, to modify, suspend or discontinue the Service at any time. In such cases if we are able to do so, we will use reasonable efforts to give you prior notice of any modification, suspension or discontinuation of the Service.

 

9.2 You agree that Airtel may suspend or terminate your access to the Service by written notice to you if-

 

9.2.1 you have violated this Agreement or other agreements or policies which may be associated with your use of the Service

 

9.2.2 your actions cause Airtel to be in violation of any agreement or policy needed to provide the Service

 

9.2.3 Airtel is required to do so by any court or government authority in any country. Airtel will not be obligated to refund any portion of your Subscription for terminations based on your breach of this Agreement, and you agree that Airtel will not be liable to you or to any third party for any suspension or termination of your access to the Service due to your breach of this Agreement.

 

9.3 You may cancel your subscription Service at any time by following these instructions: Going to Thanks Section in Airtel Thanks App. Tapping on the Secure Internet Thanks Card and tapping on unsubscribe in the Secure Internet Manage Screen and confirming the action. If you cancel your Subscription Product during your current Access Period, your access to the Subscription Services will continue until the end of the current Access Period, at which point it will expire. After this no more charges will be added to your subsequent Airtel Xstream Fiber bills. However, the charge of the current access period would have already been added to your next bill. So the charge will not be added after your next bill.

 

10. This ‘Service’ cannot be combined with any service or product other than provided by Airtel.

 

11. The benefits under this ‘Service’ are not transferable. No exchange or redemption for an equivalent cash amount or in any other form shall be allowed.

 

12. These Terms and Conditions shall constitute an agreement between Airtel and each User. By subscribing to the ‘Service’, User accepts the same as binding upon him/her.

 

13. Airtel will be entitled to postpone, suspend, modify or cancel the ‘Service’ or any aspect thereof, across the entire territories of service or any part thereof, at any time with or without notice, for any reason, including, but not limited to, acts of God, force majeure, technical difficulties, or any other reasons beyond Airtel’s reasonable control. If Airtel suspends or cancels the ‘Service’, all aspects of the ‘Service shall be null and void. Airtel will not be liable to compensate any subscriber for any postponement or cancellation or for any reason directly or indirectly arising out of this ‘Service’.

 

14. AIRTEL HAS NO LIABILITY WHATSOEVER IN RESPECT OF ANY CLAIMS OR DISPUTES AND ANY RESULTING DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT, RELATING TO THE SUBSCRIBER AVAILING, NOT RECEIVING OR SUBSCRIBER’S USE OF THE ‘OFFER’.

 

15. Any dispute or claim (contractual or non-contractual) arising out of or in relation to this Agreement, including disputes as to its formation, will be governed by and construed in accordance with Indian laws. Subject to the point above, Airtel and the subscriber submit to the exclusive jurisdiction of Courts at New Delhi alone.
